Bombay High Court Seeks State Government Response In Filing The Vacancies In Maharashtra State Commission For Protection Of Child Rights

Background of the Case:

A Public Interest Litigation (PIL) was filed raising the grievance of the petitioners that the Maharashtra State Commission for Protection of Child Rights constituted under the Commission for Protection of Child Rights Act, 2005, is non-functional due to absence of requisite number of members.

The Counsel of state (respondent) informed the Court that process was initiated in the right earnest to fill up the posts. The counsel also prayed for 2 weeks’ time to file a reply affidavit to bring on record the steps that have been taken and contemplated to be taken for appointment of members.

Observation of Court:

Court considered and granted the prayer of respondent. Court allowed respondent to file affidavit in two weeks. The matter was listed by the Court on 21st March 2022 under the heading “For Direction”.
